Terms of Service

Access: Licensor grants you a non-exclusive, non-transferable, revocable license to access the Software and basketball data for personal, non-commercial use only.

Restrictions: You may not share your login credentials. Use of the Software is limited to one (1) natural person per account. You are prohibited from reselling the data or using it to power a competing commercial service.

Billing: Access is provided via monthly or annual subscriptions. Payment is due at the start of the billing cycle. Subscriptions renew automatically until cancelled.

Refunds Policy

All purchases made through Dynatyze, including but not limited to subscription plans, one-time purchases, and any premium features or add-ons, are final and non-refundable. By completing a purchase, you acknowledge and agree to this policy.

Dynatyze does not issue refunds for any reason, including but not limited to:

• Partial use or non-use of a subscription period
• Dissatisfaction with platform features, tools, or analytics outputs
• Accidental or unauthorized purchases made through your account
• Changes to platform features, pricing, or content during your subscription term
• Cancellation of a subscription prior to the end of the current billing cycle

Subscription Cancellations

You may cancel your subscription at any time through your account settings. Upon cancellation, your access to paid features will continue through the end of the current billing period. No credit or refund will be issued for unused time remaining in that period.

Exceptions

Notwithstanding the foregoing, Dynatyze reserves the right, in its sole discretion, to issue credits or refunds on a case-by-case basis. The decision to offer a refund or credit in any instance does not obligate Dynatyze to provide the same in future cases.

Chargebacks

If you have questions about a charge or believe a billing error has occurred, please contact us at [email protected] before initiating any dispute with your payment provider.

Prohibition on Scraping:You shall not use, or allow the use of, any “robot,” “spider,” “scraper,” or other automated means to access the Site or Software for any purpose.

Liquidated Damages: Because the value of Licensor's proprietary data is difficult to quantify, you agree that if you violate this section by scraping, harvesting, or redistributing data, you shall pay Licensor $10,000 USD per occurrence as liquidated damages, and not as a penalty.

Reverse Engineering: You agree not to attempt to decompile or reverse engineer the algorithms or data structures used by Dynatyze.

League Data: By syncing your fantasy basketball leagues, you grant Dynatyze a license to access and process that data to provide you with personalized analysis.

Articles & Rankings: If you use our tools to create your own articles or rankings on the Site:

• You retain ownership of your original commentary.
• You grant Dynatyze a perpetual, royalty-free license to host, display, and distribute that content on our platform.
• You agree not to post content that is defamatory, illegal, or infringes on third-party intellectual property.

Limitation of Liability: Licensor's total liability for any claim arising out of this Agreement shall be limited to the amount of fees paid by you in the twelve (12) months preceding the claim. In no event shall Licensor be liable for incidental or consequential damages.

By creating an account or using the Dynatyze platform, you agree to receive marketing and promotional communications from Dynatyze and its affiliated brands, including No Expert Fantasy Sports / Joe Orrico. These communications may include newsletters, product updates, fantasy sports analysis, promotional offers, and other marketing materials delivered via email or other electronic means.

You may opt out of receiving marketing communications at any time by clicking the “Unsubscribe” link included in any marketing email, or by updating your communication preferences in your account settings. Opting out of marketing communications will not affect your ability to use the Dynatyze platform or receive transactional communications related to your account, such as password resets or billing notices.

By continuing to use the Dynatyze platform after the effective date of these Terms, you acknowledge that you have read and agree to receive marketing communications as described above.
